End-User License Agreement

This agreement (the "EULA") describes what you may do with Souffleuse, and the few things you may not.

1. Parties and acceptance

This agreement is entered into between you (the "User") and the Publisher of Souffleuse (the "Licensor"), publisher of the Souffleuse brand and software (the "Software"). Information about the Licensor is set out in the legal notice. By installing or using the Software, you accept this agreement.

2. Scope of the licence

The Licensor grants you a perpetual, personal, non-exclusive, non-transferable and non-sublicensable licence to install and use the Software on the Macs you own or control, for your own personal or professional needs. The licence covers the version for which it was acquired and its updates within that version.

Except to the extent expressly permitted by applicable law, you agree not to:

4. On-device nature and privacy

The Software is designed to run entirely on your Mac: it does not create an account, does not send your text to a server, and contains no telemetry or analytics at runtime. The only possible network connections are the initial download of the models and the check for updates, as described in the privacy policy, which supplements this agreement. The data the Software remembers to adapt to your style stays on your Mac, in encrypted storage.

5. Intellectual property

The Software is licensed, not sold. The Licensor and its licensors retain all rights, title and interest in the Software, its code, design, trademarks and content. No right not expressly granted by this agreement is transferred to you.

6. Third-party open-source components

The Software includes third-party components distributed under open-source licences, whose use is governed by their respective licences, which prevail over this agreement for those components only. In particular:

A complete list of components and their licences is available on request at contact@souffleuse.app. Nothing in this agreement restricts your rights under those open-source licences.

7. Limited warranty

You benefit from the applicable mandatory statutory warranties. Beyond those, and to the extent permitted by law, the Software is provided "as is", without express or implied warranty. Text suggestions are generated automatically: they may be inaccurate, and it is up to you to review them before accepting.

8. Limitation of liability

To the fullest extent permitted by law, the Licensor's liability under this agreement is limited to the minimum permitted by applicable law, and does not cover indirect or consequential damages. The limitations do not apply in case of gross negligence or willful misconduct, nor where the law prohibits them.

9. Term and termination

This agreement remains in force as long as you use the Software. It terminates automatically if you breach any of its substantial provisions. On termination, you must stop using the Software and uninstall it. The provisions on intellectual property, warranty, liability and governing law survive termination.

10. Governing law

This agreement is governed by French law, without prejudice to more protective mandatory provisions applicable to the consumer. Where the Software is offered for a fee, the purchase of the licence is concluded with the Merchant of Record Lemon Squeezy; information about the Licensor is set out in the legal notice.
